Application of Terms and Conditions.

These terms and conditions apply to all contracts between you and us.

Interpretation.

'We', 'us' and 'our', means Home of Poi Ltd.

'You', 'your' and 'importer' means the person ordering products under these terms and conditions.

'Working days' means all days other than Saturdays, Sundays, and Public Holidays.

'Product' means the product or products you have ordered from us.

Product Availability.

We update the site each working day so as to only display products that have stock available. However at times a product may become unavailable between updates. In such cases you will be contacted and informed about this, giving you the oportunity to either wait for more stock, cancel the item/order or order another item.

We will make every effort to ship the goods once payment has been received within the following working day.

The delivery times given are approximate and delays can sometimes occur. You will receive an email as soon as your order is dispatched.

You will gain legal ownership of the products you have ordered when the products have been delivered to you.

Changes and updates/improvements to products may occur without notice.

Currency Selection.

The following currencies are available to view in the shop. Click on the currency to return to shop with new currency setting. The country's currency will be used also to quote basic shipping expenses shown when viewing your cart.

 

Home of Poi has used its best commercial efforts to obtain the most accurate and timely information available pertaining to currency rates, all of which are complex and subject to rapid change.Currencies are updated on a daily basis from XE.com. Accordingly, we do not guarantee the accuracy, timeliness, reliability or completeness of any of the currencies contained on, downloaded or accessed from this website.The base currency for all product is NZD (New Zealand dollars) and all other currencies are calculated from this base value.

Shipping and Taxes.

International Air provides delivery in approximately 9 days around the world. Except for Canada and South Africa which can take 4-6 weeks (I suggest using courier for Canadian orders).

Target delivery days are for major cities and exclude weekends and public holidays.

Courier delivery is also available to some destinations, and takes 3-4 working days. Target delivery days are for major cities and exclude weekends and public holidays.

Delivery to other areas or where your item is dutiable or is held in customs may take a little longer.

New Zealand Taxes:All items purchased from customers within New Zealand, or Shipped to New Zealand will incur Goods and Services Tax (GST) at a rate of 15% on top of the cost of goods and shipping. Our system will automatically charge you GST in the shopping cart process and we will pass that on to the New Zealand Inland Revenue Department (IRD).

United Kingdom Taxes:We are able to collect VAT for the UK in the following circumstances;

  • When total of Goods weigh less than 4.9Kg,
  • When Goods value is below total of £162,
  • When Goods are less than 1 meter in length.
Value Added Tax (VAT) is charged at a rate of 20% on top of the cost of goods. If appropriate our system will automatically charge you VAT in the shopping cart process and we will pass that on to HM Revenue & Customs in the United Kingdom.
If we are unable to collect VAT then the cart will display prices as Excluding VAT, and you will be responsable to pay any tax, duty and/or clearance fee within the UK. See more about paying taxes here United Kingdom - HM Customs & excise.

All other countries:All our products are tax and duty free. However you may have to pay tax, duty and/or clearance fee within your own country.

As a general rule goods shipped by Courier or Air Mail with Tracking are more likely to incurr tax, vat etc.

The importer is ultimately responsible for paying any tax, duty and/or clearance fee owed on an import.

How much tax if any?We can not tell you if you will pay tax, duty and/or clearance fee as this is not up to us but the destination country customs department. To assist you in seeking further information we have included known links to customs websites.

Once the order has been placed.

An automatic email is sent to you with the order details with any payment instructions if required.

We reserve the right to not supply goods for any reason and return payment.

We will make every effort to ship the goods once payment has been received within the following working day.

On some occasions, we are required by the card issuer to perform additional security checks on the payment card, which can delay the order until the card has been authorised.

Once payment confirmed and goods shipped you will receive another email from us including any tracking details if applicable.

Your cancellation rights.

To cancel an order a link is provided on your order tracking pack which once clicked will automatically cancel the order and begin the refund process.

If the order has not yet been shipped and is cancelled and payment has already been made, we will refund you the purchase price.

If the order has been shipped then you must return the unwanted products to us unused and in their original packaging at your risk and at your cost within thirty days of delivery. We will credit your payment with the cost of the unwanted product.

Charging and International exchange rates.

Exchange rates for display of international currencies are updated on a daily basis. Where orders are charged to a credit card supplied direct to us we will convert the order value to the equivalent value in New Zealand currency.

Money orders and bank cheques must be of the international type. eg Australian and Canadian postal money orders are only valid within their own country.

Western Union money orders are available in most countries and are accepted by us.

You can change what currency is displayed in the shop by using the drop down selection in the top left corner of the shopping pages.

If the parcel goes missing.

All items shipped by us come with free shipping insurance. However to help receive your parcels please have your street number clearly marked outside your address for the postman/courier driver

If your item has not arrived in the stated time please contact us so we may investigate the order status.

If you have had delivery problems in your area it is adviseable to use delivery with the tracking option as it is much faster in those circumstances.

The Home of Poi Hassle Free Warranty

At Home of Poi we have a 12 month warranty/replacement process on all items purchased from us in the unlikely event that a fault occurs. This does not include claims arising from abuse or misuse.

Unlike other warranties we do not ask you to send products back at your cost, we avoid this hassle for you by simply asking for photos and/or video of the fault.

Once your claim is approved we will then send free parts/product with shipping all paid by Home of Poi or apply store credit to remedy the situation.

We feel this warranty substantially reduces the waiting times and expense for you our valued customer.

Most products can be recycled or reused locally, reducing the carbon footprint by not having to send items back and forth.

This really is the HoP hassle free, cost free, environmentally friendly warranty process.

  • All warranty/replacement claims must be made within the 12 month warranty period.
  • If any products are faulty, incorrect or damaged in transit to you, you must first contact our support team.

  • In most cases return of the damaged product is not necessary. We will not reimberse the cost of shipping items back to us unless we have instructed you to do this.
  • We reserve the right to replace at our cost, or refund the cost of the damaged or faulty goods.
  • If you feel you wish to return the goods for any other reason for a refund with return postage paid by you please return goods to our sales offices.

Ordering the wrong size.

We understand it can be difficult to always order the correct length. Our support team is happy to help you at any stage to make sure the product you order is the correct size for you.

If you find the set you received is the wrong size for you please contact our support team to help you. Quite often we have a simple solution to help you get the item adjusted or replaced.

Most practice poi sets with nylon cords can be adjusted.

Fire poi with Stainless steel cords are non-adjustable, however you can purchase new cords.

Fire poi with chain can be adjusted shorter. However you can not re -lengthen them or make them longer without special links and connectors. Chain is available separately or you can purchase new cords.
