If I were involved, I would simply refuse to prescribe the drugs. In my opinion, law or no law, it's a clear violation of the hippocratic oath.

Vanize - Naaaah.... you can go crazy at any time in the process! At the time of the crime - insanity defense. At trial - incompetence to be tried. On death row - incompetence to be executed. Only catch is, if you meet any of those standards, they lock you up in an institution, often for a longer amount of time than you would otherwise have spent in jail. There is no good solution.
My firm.. well, the firm I just left... had a case like that. The fellow was brought in on attempted murder charges, but said he heard voices telling him to do it, etc. He's been in and out of institutions, and it absolutely seems for real. So, what are the options? He gets convicted, goes to prison where he doesn't get the treatment he needs. He gets insanity, he goes to a state hospital, where he gets abused and barely gets the treatment he needs. No way out. Only hope is to convince the prosecutor to drop or lower the charges, then try to get the judge to sentence him to time served, so he can go to a private hospital and actually get the help he needs. It's a terrible case, and no matter how it ends, no one is going to be happy.
(Working for that firm was great... I got to see a cop go on the stand and testify that the Miranda warnings are just for TV. ::fear::)
I'm fascinated by mental health law, but it's in a terrible state in this country. Next semester I'm taking a mental disability litigation seminar/externship, so I'm going to sink even further into this.
Lightning - yah... I'm always amazed that they find doctors willing to give the lethal injections, since that strikes me as a violation of the Hippocratic oath as well. I've heard that often they can't, so it's non-doctors who do it... but I'm not sure on that.

ya i hate that sometimes. my brain has an endless capacity for useless knowledge (i.e. the words to Ice Ice Baby
) but can i remember the primary function of the basal ganglia which i need to know for my liscensing exam? of course not.grrr.

That's why my member status is keeper of useless knowledge...I can remember what Vanize ate the first time we went to Barnaby's together oh 6 years ago, but I can't remeber the plot of the book I read last week, or the movie I watched over the weekend...

yeah, they have HUGE burgers there, and when I eat one I am totally stuffed, and here comes along this little girl barely weighing in at 100 lbs and she polishes one off. I was asounded.

:: blushes :: I seem to astound most people (guys especially). It's ok as long as I don't eat more than a guy, then that annoys me because for some strange reason I think guys should just eat more than me...They are bigger than I am for pete's sake.

Spritie, your appetite is NOT normal. It's totally unfair to hold guys to your standard of eating. Take vanize, for instance...he's got a high metabolism too, not as high as yours...but still high...and he can't out eat you.

well, Spritie may or may not be able to out me at any given meal, but one must remember that she cannot out eat me at every meal of the day (but then, few people can).
she doesn't get hungry 3 hours after finishing a barnaby burger.
