Vanize - Naaaah.... you can go crazy at any time in the process! At the time of the crime - insanity defense. At trial - incompetence to be tried. On death row - incompetence to be executed. Only catch is, if you meet any of those standards, they lock you up in an institution, often for a longer amount of time than you would otherwise have spent in jail. There is no good solution.

My firm.. well, the firm I just left... had a case like that. The fellow was brought in on attempted murder charges, but said he heard voices telling him to do it, etc. He's been in and out of institutions, and it absolutely seems for real. So, what are the options? He gets convicted, goes to prison where he doesn't get the treatment he needs. He gets insanity, he goes to a state hospital, where he gets abused and barely gets the treatment he needs. No way out. Only hope is to convince the prosecutor to drop or lower the charges, then try to get the judge to sentence him to time served, so he can go to a private hospital and actually get the help he needs. It's a terrible case, and no matter how it ends, no one is going to be happy.

(Working for that firm was great... I got to see a cop go on the stand and testify that the Miranda warnings are just for TV. ::fear::)

I'm fascinated by mental health law, but it's in a terrible state in this country. Next semester I'm taking a mental disability litigation seminar/externship, so I'm going to sink even further into this.

Lightning - yah... I'm always amazed that they find doctors willing to give the lethal injections, since that strikes me as a violation of the Hippocratic oath as well. I've heard that often they can't, so it's non-doctors who do it... but I'm not sure on that.

ya i hate that sometimes. my brain has an endless capacity for useless knowledge (i.e. the words to Ice Ice Baby rolleyes) but can i remember the primary function of the basal ganglia which i need to know for my liscensing exam? of course not.
