I've been watching cnn on and off at work and the most recent story is essentially about how athletes are "accidentally" raping people because they belive that they are entitled to have any woman they want.

1. Does anyone have moreinfo on this story, its not on the website

2. What the HECK are they thinking?????

In Australia we often get stories about footballers (both of the AFL and Rugby persuasions) in rape allegations. sorry, no links at the moment because I have to run off to uni, but if no-one has given you any by the time I get back, I'll see what I can dig up smile

Yeah, the deal is apparently its "hard to get charges to stick" because with the "entitlement" there's no accountability.

I was completly dumbfounded by the existence of this whole "news" report. And somehow because you're a college (uni) athlete you don't follow the same laws? I mean we all know its true in practice, but this is a bit much... :/

They mention things like "some athletes are promoting sexual responsibility, but" and I'm like but what? But others can do whatever they want? I don't really care what they "think" the simple truth is you can't do stuff to people without their consent?

Anyway... I still havn't found its existence online, but it was on the tv this afternoon!

We've spoken about such "express consent" in criminal law lately. Apparently, some schools have issues such "consent cards" for their students to fill out before having sex.

Such cards are of little actual value. In the clasic rape case, for example, the lady might simply hold a gun to the poor guy's head and say "fill it out" before (or after) she raped him.

Alternatively, the guy could have filled out the card intending to consent, then changed his mind for some reason between filling it out and actually having sex. The lady forces herself on him, knowing that the card will help get her off.

Naturally, courts might consider such a card as a piece of evidence, but it would get little weight. A more effective solution would be to install video cameras everywhere, but people would probably whine about invasion of privacy and whatnot. Seems like a small price to pay in order to ensure more reliable courtroom evidence, but it seems that not everyone shares the same priorities as criminal lawers.

I recall that they're in a class which does commit more assualts than *average* but college boys in general apparently commit more than average, and college girls are apparently the most commonly assualted of any group of females.

college reads the american way college/university.

I dont understand how rape could be accidental. Thats like Italy's molestation laws that said if the victim has ever been sexually active (including everything below the neck) that the crime isn't as severe, even for young minors. I think that politicans need a lessen in anatomy.

I like the approach with the signature, though there might be loopholes as Partiarch indicated... To make this bulletproof you will have a disclaimer signed (on the condom-cover), witnesses AND video-documentation anytime you have sex with someone. Of course the disclaimer would have to specify which way/ kind of sex you prefer and it's "roughness" (tick a box)...

The positive effect would be that the Chav-to-normal ratio would drop precipitously. wink

The University of Michigan had a policy (might still) whereby students engaging in sexual activity were supposed to specifically ask their partners at each next stage of the encounter if they had their permission to do so. i.e. "Do I have your permission to take off your bra?" "Do I have your permission to lick your redface ?" etc.

So once while I was at U-M my then-boyfriend and I decided to do just this. At each step we had to ask the other if we could do...whatever.

It was actually a lot of fun. ubblol
